Contract Creation
The following steps are required to create the contract between you and us:
You place the order for your products on the Motocross World Online website by pressing the "Proceed to Secure Checkout" button at the end of the checkout process.
We will send to you an automated order confirmation email detailing the products you have ordered. Order acceptance and the completion of the contract between you and us will take place on the dispatch to you of the product(s) ordered.
Non-acceptance of an order may be a result of one of the following:
- The product you ordered being unavailable from stock.
- Our inability to obtain authorization for your payment.
- The identification of a pricing or product description error.
- You not meeting the eligibility to order criteria set out in the main Terms & Conditions.
- Insufficient details have been given in order to process the order, such as confirmed billing address.

Typographical Errors
In the event a
product is listed at an incorrect price due to typographical error or
error in pricing information from our suppliers, taxes or duty changes,
we shall have the right to refuse or cancel any orders listed at the
incorrect price whether or not the order has been confirmed but before the goods have been dispatched. If your
credit card has already been charged and we subsequently cancel your
order, we will immediately issue a credit to your credit card account
to the value of the incorrect price (including delivery charges).

Payment and Price
The total price payable for the goods will be stipulated at the time when you place your order whether or not the order has been confirmed. We are entitled to make adjustments to the price to take account of any increase in our supplier's prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been confirmed but before the goods have been dispatched. You will be informed of any price change before dispatch and have the option to cancel. All prices on our website are shown exclusive of VAT (for export orders) and inclusive of VAT but all are exclusive of delivery charges which will be payable as indicated at the time of placing your order.

Please ensure the email address you use is valid as we need this address to confirm the order process to you, most of our correspondences will be via the email address you give so please ensure its correct. Delivery Times
Delivery times are normally indicated on the product information page. We will endeavor to deliver goods within the times stated but goods are subject to availability and delay in delivery of goods is sometimes outside our control. Any dates we specify for the delivery of goods are approximate only. If we, or our suppliers are temporarily out of stock, we will notify you of this position and you should allow up to 14 days for dispatch of the goods. For delays of more than 14 days, you will have the right to cancel the order and we will refund any money paid by you for the goods.

Risk
We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Website.
As soon as we have delivered the goods to your door you will be responsible for them. We will only deliver goods to the address on the order and goods will not be left without a signature. From the time of receipted delivery of the goods, any loss or damage to the goods shall be at your own risk. Any transit damage to the goods (i.e. external damage to the box/parcel) must be noted on the delivery consignment note at the time of delivery.

Time Limitation for Notification of Claims
Damage in transit: If goods arrive in a damaged condition you must make a note on the carrier's delivery consignment note and it will be your responsibility to inform us within 7 days from delivery.
Shortages: It is your responsibility to sign for the correct number of packages as shown on the carrier's delivery consignment note. Any shortages must be noted on the consignment note and it will be your responsibility to notify us within 7 days from delivery.
In-Correct Goods: It is your responsibility to notify us of any in-correct goods supplied within 7 days from delivery.
Non-Deliveries: We will not accept liability for goods lost in transit unless we are notified within 7 days from the expected delivery date.

Product Guarantees
Most of the products supplied are covered by the terms and conditions of the Manufacturer's Guarantee. This guarantee will most likely exclude faults caused by accident, neglect, and misuse. Nothing in these conditions will reduce your statutory rights relating to faulty or misdescribed goods. Returned Goods - Refunds
Motocross World Online operates in accordance with the EU Distance Selling Directive. Should you wish to cancel your purchase, you can cancel before the goods are dispatched until 7 working days from the day after delivery, you must inform us in writing i.e. by email, post or fax, that you wish to cancel your order. We are obliged to refund your payment in full within 30 days of your cancellation. Should you cancel your purchase within this 7 day period we will refund your payment in full including delivery costs. It is your responsibility to return purchases in pristine condition in its original box and packaging. You will be wholly responsible for the cost of return delivery and safe return of the goods. Goods received back incomplete or in a damaged or used condition will be returned to you. If you do not return goods within 7 working days after you have informed us that you wish to cancel your order, we reserve the right to arrange collection of the item from you and to charge you for such collection.

Restocking Charge
A 15% restocking charge will be made to any order cancelled due to customer error after the cancellation period.
