Terms of Sale
The following steps are required to create the contract between you and us through the Website:
You place the order for your products on the Motocross World Online website by pressing the "Proceed to Secure Checkout" button at the end of the checkout process. We will then send you an automated order confirmation email detailing the products you have ordered. Order acceptance and the completion of the contract between you and us will take place on the dispatch to you of the product(s) ordered.
Non-acceptance of an order may be a result of one of the following:
- The product you ordered being unavailable from stock.
- Our inability to obtain authorization for your payment.
- The identification of a pricing or product description error.
- You not meeting the eligibility to order criteria set out in the main Terms & Conditions.
- Insufficient details have been given in order to process the order, such as confirmed billing address.
- The contracts will be concluded in English.
Product Information (Description) and Typographical Errors
It is not practical to publish comprehensive and detailed specifications of all products we sell via the Website. If you require further information, full and detailed specifications are usually available from the particular manufacturer's brochures or their websites. You can also request full description prior to your purchase or at any time during or after the processing of your order. Such inquiries can be made via any medium of communication listed on the Contact Us page on this Website.
All product specifications, images and other information published on the Website have either been made accessible by suppliers, manufacturer's, publications, publicists, or been gathered from public-domain sources. The intention of Motocross World Online is that all information on the website should be as accurate and up to date as possible. However we cannot guarantee the reliability or the accuracy of the information contained within our pages.
In the event a product is listed at an incorrect price due to typographical error or error in pricing information from our suppliers, taxes or duty changes, we shall have the right to refuse or cancel any orders listed at the incorrect price, whether or not the order has been confirmed, but before the goods have been dispatched. If your credit card has already been charged and we subsequently cancel your order and we will immediately issue a credit to your credit/debit card account to the value of the incorrect price (including delivery charges).
Availability of Goods
All products and services are subject to availability and may be withdrawn at any time. If we do not supply the goods for any reason we will not charge you for these and we will refund any money already paid for them. Inquiries about availability, unless otherwise answered in any way within the Website, can be made via any medium of communication listed on the Contact Us page.
Payment and Price
The total price payable for the goods will be stipulated at the time when you place your order, whether or not the order has been confirmed. We are entitled to make adjustments to the price to take into an account any increase in our supplier's prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong, whether or not the order has been confirmed, but before the goods have been dispatched. You will be informed of any price change before dispatch and have the option to cancel. All prices on our website are shown exclusive of VAT (for export orders) and inclusive of VAT, but all are exclusive of delivery charges which will be payable as indicated at the time and date of placing your order.
On the order you must provide us with your exact billing address, telephone number and email address - the postal address must be the same as your credit card bank has on file for you. Please ensure the email address you use is valid, as we need this address to confirm the order process/status to you. Most of our correspondences will be via the email address you give us, so please ensure it is correct. Incorrect information will cause a delay in processing your order and/or cancellation.
We accept all major credit and debit cards and PayPal as methods of payment. We require full payment at the moment of purchase and no orders will be confirmed and dispatched otherwise. Vouchers, gift certificates and promotional codes can be used towards the payment of any order you place, as long as they are issued by the Company, in-date and not prohibited by any other offer, condition or provision outlined in these Terms and Conditions. If you cannot redeem your vouchers, promotional codes or gift certificates at the Check Out, they might not meet one or several rules within the Website and you might require assistance in order for them to be validated. In such cases please use the Contact Us page to communicate your problem.
Delivery Options, Charges and Times
Depending on the delivery address you have stated in your order, the value of your order and the urgency of the delivery, the automated system will provide you a choice of delivery methods that apply to your order. This may include, but is not limited to, Royal Mail (1st Class, Special delivery and Saturday delivery), Royal Mail International, Air Mail, Interlink (DPD) or Collect in Store. You must select only one delivery option and apply it to your order during the order placing process. You will receive a conformation via email with your order summary and delivery option.
Delivery charges are applicable to all orders and all prices on the Website are exclusive of delivery charges. Those charges will be added to the price of the products at our checkout. Delivery charges vary depending on the type of products, the value of the order and service you require – all available methods are presented to you at the checkout.
Delivery times are normally indicated on the product information page. We will endeavour to deliver goods within the times stated, but goods are subject to availability, and delay in delivery of goods is sometimes outside our control. Therefore any estimated dates we specify for the delivery of goods, are approximate only. If we, or our suppliers, are temporarily out of stock, we will notify you of this position and you should allow up to 14 days for dispatch of the goods. For delays of more than 14 days, you will have the right to cancel the order and we will refund any money paid by you for the goods.
Most of the products we supplied are covered by the terms and conditions of the Manufacturer's Guarantee. This guarantee will most likely exclude faults caused by accident, neglect, and misuse. Nothing in these conditions will reduce your statutory rights relating to faulty or falsely described goods. For further information about your statutory rights contact your local authority Trading Standards Service or Citizens' Advice Bureau.
We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer, if a third party procures unauthorized access to any data you provide when accessing or ordering from the Website.
As soon as we have delivered the goods to your door you will be responsible for them. We will only deliver goods to the address on the order, and goods will not be left without a signature, if the delivery option requires one. From the time of receipted delivery of the goods, any loss or damage to the goods shall be at your own risk. Any transit damage to the goods (i.e. external damage to the box/parcel) must be noted on the delivery consignment note at the time of delivery.
We will not be held liable if the delivery has not been made successfully due to wrong information provided by you, your inability to collect the delivery or if the delivery service is experiencing issues with processing or delivering your order.
Returns, Refunds and Re-stock Charges
Motocross World Online operates in accordance with the EU Distance Selling Directive. Should you wish to cancel your purchase, you can cancel before the goods are dispatched or up until 7 working days after delivery. You must inform us in writing i.e. by email, post or fax that you wish to cancel your order. We are obliged to refund your payment in full within 30 days of your cancellation. Should you cancel your purchase within this 7 day period we will refund your payment in full including delivery costs. It is your responsibility to return purchases in pristine condition in its original box and packaging. You will be wholly responsible for the cost of return delivery and safe return of the goods. This may include, but it is not limited to, 1st Class and Special Royal Mail delivery or courier services.
Goods received back incomplete or in a damaged or used condition will be returned to you. If you do not return goods within 7 working days after you have informed us that you wish to cancel your order, we reserve the right to arrange collection of the item from you and to charge you for such collection. If you wish to return your purchase after the 7 day return period, a 15% re-stocking fee will be applied to the order, and you will be responsible for the cost of safe return delivery of the goods you have purchased.
Damage in transit: If goods arrive in a damaged condition you must make a note on the carrier's delivery consignment note and it will be your responsibility to inform us within 7 days from delivery.
Shortages: It is your responsibility to sign for the correct number of packages as shown on the courier's delivery consignment note. Any shortages must be noted on the consignment note/customer invoice and it will be your responsibility to notify us within 7 days from delivery.
Incorrect Goods: It is your responsibility to notify us of any incorrect goods supplied within 7 days from delivery.
Non-Deliveries: We will not accept liability for goods lost in transit unless we are notified within 7 days from the expected delivery date.
